§ 34-161. Equivalent mass and concentration limits.

  • (a)

    When the limits in a categorical pretreatment standard are expressed only in terms of mass of pollutant per unit of production, the control authority may convert the limits to equivalent limitations expressed either as mass of pollutant discharged per day or effluent concentration for purposes of calculating effluent limitations applicable to individual industrial users.

    (b)

    Equivalent limitations calculated in accordance with 40 CFR 403.6(c)(3) and (c)(4) shall be deemed pretreatment standards for the purposes of section 307(d) of the act and 40 CFR 403. Industrial users will be required to comply with the equivalent limitations in lieu of the promulgated categorical pretreatment standards from which the equivalent limitations were derived.

    (c)

    The standards set forth in 40 CFR 403.6(c)(6) and (c)(7) shall apply to those industrial users for whom equivalent mass or concentration limits are calculated.
