§ 34-118. Misdemeanor.

  • A person who violates any provision of this division that is listed in this section is guilty of a misdemeanor. Such misdemeanors are subject to a fine of not more than $500.00 or the maximum allowable under state law, plus costs and other sanctions, or by imprisonment for a period not to exceed 90 days, or both such fine and imprisonment. Misdemeanor violations shall include:

    (1)

    Intentional unpermitted discharge;

    (2)

    Falsification of monitoring report;

    (3)

    Improper sampling, with evidence of intent to falsify or mislead;

    (4)

    Intentional failure to install monitoring equipment after deadline was established by administrative order;

    (5)

    Intentional recurring violation of compliance schedule in permit, or a violation of a compliance schedule in an administrative order; and

    (6)

    Illegal discharge when the discharge causes harm and there is evidence of intent to harm.
