§ 20-10. Restricted access for persons with a history of committing vandalism.

  • (a)

    In order to maintain the security, safety and aesthetic appearance of township parks, a person who pleads guilty to, or is convicted of, an act of vandalism in any local, state or national park shall be prohibited from entering or being in any park owned or operated by the township for a period of two years from the date of such conviction.

    (b)

    A person restricted under this section may apply to the township clerk for permission to enter a township park on a date specified by the applicant and only for the purpose of exercising the rights guaranteed by the Michigan Constitution of 1963, Article I, Sections 3, 4 and 5, and by the First Amendment to the United States Constitution. The township clerk shall grant such permission, provided that the applicant has previously paid the judgment for damages as determined by the court in accordance with section 20-9, if applicable. In no event shall such permission be denied based upon the content of the applicant's constitutionally protected activity. There shall be no limit as to the amount of times a restricted person may apply for permission to enter a township park under this section.
