§ 16-84. Assessment of expenses; joint and several responsibility; assessment of insurer.

  • Pursuant to the authority granted in Public Act No. 102 of 1990 (MCL 41.806a, MSA 5.2640(6a)), as amended, the fire chief or his authorized representative may, on behalf of the township, assess a fee for all expenses incurred by the township fire department in abating the discharge, release or accumulation. This fee shall include, but not be limited to, the actual labor and material costs to the township, including workers' compensation benefits, fringe benefits, administrative overhead, cost of equipment operation, cost of materials, cost of disposal, cost of any contract labor or materials and any other cost, associated with abatement, mitigation and cleanup. This fee shall be assessed to, and shall be the joint and several responsibility of each person who has caused, suffered to be caused or in any way contributed to such discharge, release or accumulation, regardless of whether that person has any other legal liability therefor apart from this section. The fire chief or his authorized representative may charge this fee directly to the insurer of any person made responsible under this section.
