§ 17.9. Amendments, expiration, and validity.

  • A.

    Amended documents. Amendments to any site condominium document that significantly impact the approved site condominium site plan, or any conditions of the site condominium site plan approval, shall be submitted to the planning commission and township board for review and decision prior to the issuance of a building permit.

    B.

    Validity. Site improvements shall be commenced within one year after the date of approval of the final site condominium plan.

    C.

    Extension. The zoning administrator may approve two extensions of up to one year each, if requested in writing by the applicant prior to the expiration date of the original approval or first extension. The extension shall be approved if the applicant presents reasonable evidence to the effect that the development has encountered unforeseen difficulties beyond the control of the applicant, and the project will proceed within the extension period. If the above provisions are not fulfilled or the extension has expired prior to construction, the final site condominium plan approval shall become null and void.

    D.

    Rescinding approval of a site condominium plan. Site condominium plan approval may be rescinded by the township board, following a review and recommendation from the planning commission upon determination that the site has not been improved, constructed or maintained in compliance with approved permits, plans, or conditions of approval.
