Latest version.
  • A.

Permit. A special land use permit, with all associated benefits, conditions and required security shall run with the land. Any change of property ownership does not invalidate the special land use approval; provided, all conditions of approval continue to be met.

    B.

Validity. A special land use permit shall be valid for as long as the approved special land use continues in accordance with the terms and conditions of the approved permit. The special land use permit shall expire on the occurrence of one or more of the following conditions:

    1.

If replaced or superseded by a subsequent special land use permit.

    2.

If replaced or superseded by a permitted use.

    3.

If the applicant requests the rescinding of the special land use permit.

    4.

Site improvements are not commenced within one year after the date of approval of the site plan.

    C.

Compliance. Ongoing conformance with the terms and conditions of the approved permit is required.

    D.

Extension. The zoning administrator may approve two extensions of up to one year each, if requested in writing by the applicant prior to the expiration date of the original approval or first extension. The extension shall be approved if the applicant presents reasonable evidence to the effect that the development has encountered unforeseen difficulties beyond the control of the applicant, and the project will proceed within the extension period. If the above provisions are not fulfilled or the extension has expired prior to construction, the special land use approval shall become null and void.
